Government Code Ch. 423 (2013/2015)
Texas Privacy Act — prohibits drone surveillance of private property and individuals without consent.
SB 840 (2017)
Prohibits drone operations near critical infrastructure and correctional facilities.
Restrictions
- No surveillance of private property or individuals without consent (with 25 enumerated exceptions)
- No flying within 400 feet of critical infrastructure
- No flying over correctional facilities
- No flying over sports venues during events
Penalties
Class C misdemeanor for privacy (up to $500). Class B for critical infrastructure (up to $2,000 and 180 days jail).
Local Flying Notes
Texas has extensive drone legislation but also many exceptions for professional use. Houston, Dallas-Fort Worth, Austin, and San Antonio have large, active FPV communities. Year-round flying weather in most of the state.
